TLDNR: one accused pleaded guilty, and another accused will take a guilty plea in January.

I was expecting two pleas for two convoy-related matters in the Ontario Court of Justice in Ottawa. The first one was Pierre Ringette, who seems to be a Veteran from New Brunswick, and the second a Nicholas Smith.


The accused Pierre Ringuette is adjourned. The defence counsel Youness Marwa spoke with the crown and asked for an 11b waiver. Pierre Ringuette's matter is adjourned to January for a plea and sentencing. The Crown didn’t object to the 11b waiver.


Both accused are represented by the Defence counsel Youness Marwa. 

Defence counsel Youness Marwa for Nicholas Smith. The matter was scheduled for 2 Pm, but it was moved forward earlier. L’Oignon Giroux is the crown in this matter. Smith will plead to count two and count 3 of his criminal information. The Crown and the Defence were previously not in agreement with the facts.  The counsel also made a plea inquiry


Nicholas Smith was charged on 19 days of February in Ottawa for assaulting a peace officer engaging in the execution of his duty in February and obstructing a peace officer engaging in the execution of his duties. Crown elected summarily in July. Smith has chosen to plead guilty


The client of Youness Marwa, Nicholas Smith, does not admit the context of the freedom convoy in the facts of the summary conviction. Justice takes notice, and the crown will file a redacted prosecution summary.


A redacted version of the facts would be filed in court. The Justice notably takes notice that there was a protest by the name of “freedom convoy” that stated in Ottawa that caused distribution by gridlocking the city. The justice also takes notice that there were court orders that were distributed to the protestors to disperse


On February 19th of 2022, Nicholas was on banks and sparks smith. Mr. Smith was wearing a gas mask and a yellow vest. Police officers were in a line, and Mr. Smith approached the line, lowered his gas mask and spat on an officer from the Calgary police service. The assault was captured on video.


Smith was told by police to leave the area and refused to leave. Smith was subsequently arrested for the assault on the police officer


Nicholas Smith agreed to the facts that were read at court and pleaded guilty to his two counts


Youness Marwa asks for an adjournment so that his client can complete the steps before sentencing. Counsel Marwa asks for a three-month adjournment


The matter adjourned back to January 27th, 9 AM, in courtroom 5 for sentencing.
